لايحه قانوني مربوط به پروتكل مورخ 1979 راجع به پنجمين تمديد كنوانسيون تجارت گندم بتصويب شوراي انقلاب جمهوري اسلامي ايران رسيده است بپيوست ابلاغ ميگردد

ماده واحده- به پروتكل مورخ 1979 راجع به پنجمين تمديد كنوانسيون تجارت گندم1971به شرح ضميمه كه در ماه مه 1979 از طرف نماينده دولت جمهوري اسلامي ايران بامضأ رسيده است تصويب وبه وزارت امور خارجه اجازه داده ميشود كه در مورد مبادله اسنادمربوط اقدام لازم به عمل آورد

مقدمه:
كنفرانس مسئول تهيه متون پروتكلهاي1979 براي پنجمين تمديد كنوانسيونهاي تشكيل دهنده موافقتنامه بين المللي گندم 1971
باتوجه به اين كه موافقتنامه بين المللي گندم1949در سالهاي 1953، 1956 ،1959، 1962 ،1965 ،1966 ،1967 ،1968 ،1971 ،1974 ،1975 ،1976 و1978 اصلاح، تجديد يا تمديد شده است .
وبا توجه با اينكه موافقتنامه بين المللي گندم 1971 متشكل از دو سند قانوني جداگانه- كنوانسيون تجارت گندم1971وكنوانسيون كمك غذائي
1971 كه هر در سال 1978 بوسيله پروتكل تمديد شده-در تاريخ30 ژوئن 1979 منقضي خواهدشد .
متون پروتكيلهاي 1979 براي پنجمين تمديد كنوانسيون تجارت گندم1971و كنوانسيون كمك غذائي1971 را تهيه نموده است .
پروتكل1971براي پنجنمين تمديد كنوانسيون تجارت گندم 1971
دول عضو اين پروتكل –
با توجه به اين كه مدت اعتباركنوانسيون تجارت گندم 1971(كه از اين پس «كنوانسيون»ناميده خواهد شد)ازموافقتنامه بين المللي گندم 1971 كه بوسيله پروتكل در سال 1978 تمديد شده- در تاريخ 30 ژوئن1979 منقضي خواخد شد – بشرح زير موافقت نموده اند:
ماده1
تمديد-انقضاء مدت و اختتام كنوانسيون
بر طبق مفاد ماده 2 اين پروتكل – كنوانسيون تا تاريخ 30 ژوئن 1981 بين كشورهاي عضو پروتكل لازم الاجراءخواهد بود مشروط برآنكه ازموافقتنامه بين المللي جديدي در خصوص گندم قبل از تاريخ 30 ژوئن1981 بمرحله اجرا درآيد –اين پروتكل فقط تا تاريخ لازم الازم الاجراء شدن موافقتنامه جديد معتبر خواهد بود.
ماده2
مفاد بلا اثر كنوانسيون
از تاريخ اول ژوئيه1979 موارد زير از مقررات كنوانسيون بلااثرخواهد بود:
(الف) بند 4 ماده 19
(ب) موارد 22تا 26 (شامل26)
(ج)بند 1ماده 27
(د)موارد 29تا31 (شامل31)
ماده3
تعريف
هر گونه ذ كري از «دولت »يا«دولتها» در اين پروتكل شامل اشاره به جامعه اقتصادي اروپا (كه ازاين پس«جامعه» ناميده ميشود )تلقي خواهد شد.
بهمين ترتيب در اين پروتكل هرگونه ذكري از «امضاء»يا«توديع اسناد تصويب ،پذيرش ، تأييد يا انعقاد» يا «سند الحاق» ويا «اعلاميه اجراي موقت»
توسط يك دولت –در مورد جامعه چنان تلقي خواهد شد كه شامل امضاءيا اعلام اجراي موقت از طرف جامعه بوسيله مقامذيصلاح آن وتوديع سند مورد نياز طبق رويه هاي اداري جامعه كه لازمه انعقاد هر قرارداد بين المللياست ،باشد .
ماده4
امور مالي
سهم اوليه قابل پرداخت هر يك كشورهاي صادر كننده يا وارد كننده كه طبق قسمت (ب) بند (1)ماده (7) به اين پروتكل ملحق ميشوند توست شورا براساس آرائي كه به آن كشور تعلق خواهد گرفت و مدتي كه از سال زراعتي جاري باقيمانده است تعيين خواهد شد ولي مقدار تعيين شده براي ساير كشورهاي عضو صادر كننده وواردكننده براي سال زراعتي جاري تغييري نخواهد كرد .
ماده 5
امضاء
اين پروتكل از تاريخ 25 آوريل 1979 لغايت 16 مه 1979 براي امضاي كشورهاي عضو كنوانسيون تمديد شده بوسيله پروتكل 19778 يا كشورهايي كه در تاريخ 21مارس 1979 عضوموقت كنوانسيون تمديد شده بوسيله پروتكل 1978 محسوب ميگردديا كشورهايي كه عضو سازمان ملل متحد،سازمانهاي تخصصي آن يا سازمان بين المللي انرژي اتمي ميباشد ونام آنها در فهرست هاي ضميمه (الف) و(ب) كنوانسيون قيد شده ،در واشينگتن مفتوح خواهد بود.
ماده6
تصويب، پذيرش ،تأييدياانعقاد
اين پروتكل موضوع تصويب ،پذيرش تأييدياانعقادهر دولت امضاء كننده بر طبق قوانين اساسي يا مقررات سازماني دولت مربوطه خواهد بود .اسناد تصويب و پذيرش وتأييد يا انعقاد يا تا تاريخ 22 ژوئن 1979نزد دولت ايالات متحده آمريكا توديع گردد مگر اينكه شورا اين ضرب الاجل را يك يا چند بار براي دولت امضاء كننده اي كه اسناد تصويب و پذيرش وتأييديا انعقادرا تا تاريخ فوق توديع ننموده است تمديد نمايد
ماده 7
الحاق
1- اين پروتكل بشرح زير جهت الحاق مفتوح خواهد بود:
(الف)- تاتاريخ 22ژوئن 1979براي الحاق دولتهايي عضو كه در آنتاريخ در فهرستهاي (الف) يا (ب) كنوانسيون قيد شده اند .شورا ميتواند اين ضرب الاجل را يك يا چند بار در مورد دولتي كه تاتاريخ فوق سند الحاق خود را توديع ننموده است تمديد نمايد – و
(ب)-بعد از تاريخ 22ژوئن 1979براي الحاق دولتهاي هر دولت عضو سازمان ملل متحد يا سازمانهاي تخصصي آن يا سازمان بين المللي انرژي اتمي بموجب شرايطي كه شورا مقتضي بداند يا دو سوم آراء كشورهاي صادر كننده و دو سوم آراء كشورهاي وارد كننده .
2- الحاق با توديع سند الحاق نزد دولت ايالات متحده آمريكا رسميت مييابد .
3- هر جابمنظور اجراي كنوانسيون و اين پروتكل به اعضاي مندرج در فهرستهاي ضميمه (الف) يا (ب) كنوانسيون اشاره شود نام هر كشور عضوي كه دولت مطبوعه آن بر طبق شرايطي كه شورا مقرر داشته به كنوانسيون ويا طبق مفاد قسمت (ب) بند(1) اين ماده به پروتكل ملحق شده باشد بايد
مندرج در فهرست ذيربط صميمه تلقي گردد .
ماده 8
اجراي موقت
هر دوات تمضاء كننده ميتواند اعلاميه اجراي موقت اين پروتكل را نزد دولت ايالات منحده امريكا توديع نمايد .همچنين هر دولت ديگر حائز شرايط براي امضاي اين پروتكل يا هر دولتي كه درخواست الحاق آن به تصويب شورا رسيده باشد ميتواند اعلاميه اجراي موقت نزد دولت ايالاتمتحده امريكا توديع نمايد .هر دولتي كه چنين اعلاميه اي را توديع مينمايد مفاد اين پروتكل را بطور موقت اجرا خواهد نمود و موقتا" طرف اين پروتكل بشمار خواهد رفت .
ماده 9
لازم الاجراشدن
1- اين پروتكل فيمابين دولتهايي كه اسناد تصويب ،پذيرش ، تائيد ،انعقاد يا الحاق ويا اعلاميه اجراي موقت را بر طبق مواد (6)و(7)و(8)اين پروتكل تا تاريخ 22ژوئن 1979توديع نموده اند به ترتيب زير لازم الاجرا خواهد گرديد:
(الف)-در تاريخ 23ژوئن 1979 نسبت به كليه مقررات كنوانسيون بجز مواد (3)تا(9)و ماده (21) –و
(ب)در تاريخ اوليه ژوئيه 1979 نسبت به مواد (3)تا(9)و ماده (21) كنوانسيون در صورتي كه چنين اسناد تصويب ،پذيرش ، تائيد ،انعقاد يا الحاق ويا اعلاميه اجراي موقت تا تاريخ 22ژوئن 1979از طرف دول صادر كننده عضو كه شصت در صد آراء قيد شده در فهرست ضميمه (الف)را در دست دارند و همچنين دول وارد كننده عضو كه 50% آراء قيد شده در فهرست ضميمه (ب) را در دست دارند يا اينكه اگر در همان روز عضو كنوانسيون ميشدند همان تعداد آراءرا در دست ميداشتند ،توديع شده باشد .
2- اين پروتكل درمورد هر دولتي كه سند اسناد تصويب ،پذيرش ، تائيد ،انعقاد يا الحاق را طبق مقررات مربوطه ين پروتكل بعد از تاريخ 22ژوئن1979توديع مينمايداز تاريخ توديع لازم الاجراء خواهدشد هيچ يك از مقررات اين پروتكل در مورد چنين دولتي لازم الاجرا ء نخواهد شد مگر اينكه قبلا" در مورد دول ديگر طبق بندهاي (1)يا(3)اين ماده بموقع اجرا در آمده باشد.
3- در صورتيكه اين پروتكل طبق بند (1) اين ماده لازم الاجراء نگردددولتهاييكه اسناد تصويب ،پذيرش ، تائيد ،انعقاد يا الحاق ويا اعلاميه موقت راتوديع كرده اند ميتوانند با توافق متقابل تصميم بگيرند كه اين پروتكل فيمابين دولتهاييكه اسناد تصويب ،پذيرش ، تائيد ،انعقاد يا الحاق ويا اعلاميه اجراي موقت را توديع نموده اند لازم الاجرا شود.
ماده 10
اعلام بوسيله دولت نگهدارنده اسناد
دولت ايالات متحده امريكا بعنوان دولت نگهدارنده اسناد مراتب امضاءتصويب ،پذيرش ،تأييد ،انعقاد ،اجراي موقت و الحاق به اين پروتكل و نيز كليه اطلاعيه ها – يادداشتهاي واصله طبق ماده (27)كنوانسيون و هرگونه اعلاميه و اطلاعيه واصله بر طبق ماده (28)را بتمام دولتهاي امضاءكننده و ملحق شونده اين پروتكل ابلاغ خواهد نمود .
ماده 11
نسخه گواهي شده پروتكل
در اولين فرصت ممكن ضس از لازم الاجرا شدن قطعي اين پروتكل دولت نگهدارنده نسخ گواهي شده متون انگليسي ، فرانسه ، روسي واسپانيولي پروتكل را براي دبير كل سازمان ملل متحد جهت ثبت طبق ماده (102) منشور ملل متحد ارسال خواهد داشت . هرگونه اصلاحيه درمورد اين پروتكل نيز بهمين منوال بلطلاع خواهد رسيد .
ماده 12
ارتباط مقدمه با پروتكل
اين پروتكل مقدمه بر پروتكلهاي پنجمين تمديد موافقتنامه بين المللي گندم 1971 را شامل ميباشد .

CONSTITUTING THE INTERNATIONAL WHEAT
AGREEMENT,1971
PREAMBLE
The Conferens to eastblish the text of the 1979 Protocol for the fifth extension of the conventions contituting the international Wheat agreement , 1971
Considering that the International Wheat Agreement of 1979 was revised , reneved or extended in 1935 , 1956 , 1959 , 1962 , 1965 , 1966 , 1967 , 1968 , 1971 , 1974 , 1975 , 1976 and 1978
Considering that the International Wheat Agreement , 1971 , Consisting of two separate legalinstruments, the Wheat Trade Convention , 1971 and the Food Aid convention , 1971, both of which waere furtherextended by Protocol in 1978 , will expire on 30 june 1979,
Has easablished the text of the 1979 Protocols for the fifth extension of the Wheat Trade Convention, 1971 and for the fifth extention of the Food Aid CONVENTION ,1971.
1979 PROTOCOL FOR THE FIFTH
EXTENSION OF THE WHEAT TRADE
CONVENTION ,1971
The Governments party to this Protocol:
Considering THAT THE WHEAT TARDE Convention , 1971(hereinafter referred to as ''the convention'') of the Intrnatinal wheat agreement , 1971 , which was futher extended by Protocol in 1978 , extpires on 30 june 1979,
Have agred ar follows:
ARTICLE 4
Extension , expiry termination of the convention
Subject to the provisisions of artile 2 of this Protocol , the convention shall continue in force between the parties to this Protocol until 30 june 1981 provided that , if anew inter national agreement covering wheat enters into force before 30 june 1981 this Protocol shall remain in forse only until the date of entry into force of the new agreement .
ARTICLE 2
Inopertive provisions of the convention
The following Provisions of the Convention shall be deemed to be inoperative with effect from 1 July 1979:
(a) paragraph (4) of article 19:
(b) articele 22 to 26 inclusive ;
(c) paragraph (1) of Article 27;
(d) Articles 29 to 31 inclosive .
ARTICLE 3
Definition
Any reference in this protocol to a <>or <> shall be construed as including a refrence to the European Economic (hereinafter refrerred to as <>).Accordingly ,any refrence in this Protocol to ,,signature,,or to the ,,deposit of ratification ,acceptance, approval or or conclusion ,, or,,an insrtrument of accession ,, or ,,a declaration of provisional application ,, bya government shall ,in the case of the community, be construed as including signature or declaration of provisional application on behalf of the community by its competent authority and the deposit of the instrument required by the institutional procedures of the community to be deposited for the conclusion of an international agreement.
ARTICLE 4
Finance
The initial cotribution of any exporting or importing member acceding to this protocol under paragraph (1) (b) of article 7 there of , shall be assessed by the council on the basis of the votes to be distributed to it and the period remaining in the current crop year, but the assessment made upon other exporting and importing members for the current crop year shall not be alterd.
ARTICLE 5
Signture
This protocol shall be opsn for signature in washington from 25 April 1979 until and including 16 may 1979 by governments of countries party to the convention as fhrther extended by the 1978 protocol , or which are provisionally regarded as party to the convention further extended by the 1978 protocol , on 21 march 1979 , or which are member of the united nations , of its specialized agenciens or of the international atomic engry agency , and are listed in annex a or annex b to to convention .
ARTICLE 6
Ratification , acceptance, approval or conclusion
This protocol shall be subject to ratification , acceptanc , approval or conclusion by each signatory government in accordance . Instrument of ratification acceptance , aproval or conclusion shall de deposited whit the government of the united states of america not later than 22 june 1979, exept that the counicil may garant one or more extensions of time to any signatory government that has not deposited its instrument of ratification , acceptance, approval or conclusion by that date.
ARTICLE 7
Accession
(1) this protocol shall be open for accession
(a)until 22 june 1979 by the government of any member listed in annex A or B to the convention as of that date , except that the council may garant one or more extensions of time to any government that has not deposidet its instrument by that date , and
(b)after 22 june 1979 by the government of any member of the united nations, of its specialized agencied or of the intrenational atomatic energy , upon such conditions as the council considers appropriate by not less than two thirds of the votes cast by importing members .
(2)Accession shall be effected by the deposit of an instrument of accession with the government of the united states of america .
(3)where , for for the purposes of the operation of the convention and this protocol , reference is made to members listed in annex A or B to the convention , any member the government of which has acceded to the convention on conditions prescribed by the council , or o this protocol in accordance whit paragraph (1) (b) of this article , shall be deemed to be listed in the approprite annex.
ARTICLE 8
Provisional application
Any signatory government may deposit whit the government of the unated states of america a declration of provisional application of this protocol any other government eligible ti sign this protocol or whose applicatin for accession is aproved by the council may also deposij whit the government of the united states of america a declaration of provisional applicatin . any government depositing such a declaration shall provisionally apply this protocol and be provisionally regarded as a party thereto.
ARTICLE 9
Entry into force
(1) this protocol shall enter into force among those governments which have deposited instruments of ratification , acceptance, approval , conclusion or accession, or declarational application , in accordance whit articles 6,7 and 8 of this protocol by 22 june 1979 as follows:
(a)on 23 june 1979 whit aespect to all provisions of the convention other than article 3 to 9 inclusive and article 21, and
(b) on 1 june 1979 whit respect to article 3 to 9 inclusive , and article 21 of the convention , if such instruments of ratification , acceptance , approval , conclusion or accession , or declarations of provisional application have been deposited not later than 22 june 1979 on behalf of government repressenting exporting members which held at least 60 per cent of the votes set out in annex A and representing importing members which held at least 60 per cent of the votes set out in annex b , or would have held such votes respectively if they had been parties to the convention on that date .
(2)this protocol shall enter in to force for any gover ment that deposist an instrument of ratification' acceptance , approval ,conclusion or accession after 22 june 1979 in accordance whit the relevant
provisions of this protocol , on the date or such deposit exept that no part of it shall enters force for such a government until that part enters into force for other government under paragraph (1) or
(3)of this article .
(3)if this protocol dose not enter into force in accordance whit paragraph (1)of this article , the goverments which have deposited instruments of retification , acceptance ,approval , conclution or accession or declaration of provizional application , may decide by mutual consent that it shall enter into force among those governments that have deposited instrument of retification , acceptance , approval , conclusion or accession or declarations of provisional application .
ARTICLE 10
Notificationby depositary government
To government of the united states of america as the depositary government shall notify all signatory and acceding government of each signature , ratification acceptance, approval , conclusion, provisional application of, and accession to , this protocol as well as of each notification and notice received under article 27 of the convention and notification received under article 28 of the convention.
ARTICLE 11
Certified copy of the protocol
As soon as possible after the definitive entry force of this protocol the depositary government shall send a certified copy of this protocol in the English,French,Russian and Spanish languages to the secretary general of the united nations for registration in accordance whit article 102 of the charter of the united nations. Any amendments to this protocol shall likewise be communicated.
ARTICLE 12
Relation if preamble to protocol
This proocol includes the preamble to the 1979 protocol for fifth extension of the International wheat agreemwnt ,1971.
